Los Gobiernos reconocen la obligación de controlar a las empresas militares y de seguridad privadas

En una reunión celebrada en la ciudad de Montreux, Suiza, se reafirmaron las obligaciones de los Estados en relación con las empresas militares y de seguridad privadas en zonas de guerra. En dos puntos clave del documento aprobado por 17 países, se establece que el hecho de delegar tareas a un contratista no libera a los Estados de sus responsabilidades, y que los Gobiernos no deberían permitir la participación de contratistas en operaciones de combate.

En el documento de Montreux se reafirma la obligación de los Estados de velar por que las empresas militares y de seguridad privadas que operan en conflictos armados respeten el derecho internacional humanitario (DIH) y el derecho de los derechos humanos. Por otra parte, el documento contiene unas setenta recomendaciones, derivadas de las mejores prácticas de los Estados, por ejemplo verificar los antecedentes de las empresas y examinar los procedimientos que utilizan para investigar a los miembros de su personal. También se recomienda que los Estados adopten medidas concretas para garantizar que los miembros del personal de las empresas militares y de seguridad privadas puedan ser sometidos a juicio en caso de que cometan infracciones graves del DIH.

"Idealmente, los Estados no deberían encargar a los contratistas privados que participen activamente en las operaciones de combate", dijo Philip Spoerri, director de Derecho Internacional del CICR. "En los conflictos armados, las funciones de combate deben permanecer dentro del ámbito de responsabilidad de los Gobiernos y no se deben externalizar a contratistas privados".

Hasta ahora, 17 países (Afganistán, Alemania, Angola, Australia, Austria, Canadá, China, Estados Unidos, Francia, Irak, Polonia, Reino Unido, Sierra Leona, Sudáfrica, Suecia, Suiza y Ucrania) han adoptado el documento de Montreux, así denominado por la ciudad suiza a orillas del lago de Ginebra donde se reunieron los expertos gubernamentales del 15 al 17 de septiembre de 2008 para examinar la forma de mejorar la regulación de los contratistas militares y de seguridad privados. El Departamento de Asuntos Exteriores de Suiza lanzó esta iniciativa en 2006, y el CICR se asoció estrechamente a ella desde un principio. Durante el proceso, se realizaron frecuentes consultas con el sector de las empresas militares y de seguridad privadas, así como con diversas ONG.

Paul Seger, asesor jurídico del Departamento suizo de Asuntos Exteriores, destacó que el objetivo de la iniciativa suiza era puramente humanitario. "Deseábamos corregir la percepción de que, cuando los Estados subcontratan tareas militares o de seguridad a empresas privadas, se producen situaciones de vacío jurídico. Por el contrario, en situaciones de conflicto armado, el DIH se aplica tanto al Estado como al contratista privado", dijo el Sr. Seger. "Es muy importante que las medidas administrativas y jurídicas recomendadas en el documento sean ahora puestas en práctica por los países que lo apoyan". Suiza alienta a otros Estados a sumarse a la iniciativa.

El CICR subrayó los beneficios del documento de Montreux para los países y para las personas afectadas por los conflictos armados. "El documento constituye una excelente base a partir de la cual el CICR podrá debatir cuestiones de índole humanitaria con todos los países donde operan empresas militares y de seguridad privadas, o donde esas firmas tienen su base", señaló el Sr. Spoerri. "Sus recomendaciones, de carácter muy práctico, serán especialmente útiles para los Estados que tienen gobiernos débiles o que afrontan las repercusiones de un conflicto armado, pero que tienen interés en reglamentar el accionar de esas compañías en su territorio".

Hacer que las compañías militares y de seguridad privadas respeten el derecho

La externalización de las actividades militares y de seguridad mediante la contratación de compañías privadas es un hecho cada vez más frecuente que plantea cuestiones sobre cuáles son las normas que regulan el comportamiento de estas empresas en situaciones de conflicto. La asesora jurídica del CICR, Cordula Droege, comenta una iniciativa del Gobierno suizo para promover el respeto del derecho internacional humanitario y proponer algunas medidas con las cuales abordar esta cuestión.

¿Cómo surgió la iniciativa suiza sobre las empresas militares y de seguridad privadas? La idea surgió del Departamento Federal de Asuntos Exteriores Suizo. Dada la presencia cada vez mayor de las empresas militares y de seguridad privadas (EMP/ESP) en países donde tiene lugar un conflicto armado, incluida la ocupación, el Departamente Federal de Asuntos Exteriores pensó que sería útil entablar un proceso de diálogo y reflexión entre los Estados acerca de las normas jurídicas aplicables.

Este proceso señalaría también las medidas que los Estados podrían adoptar para promover el respeto del derecho internacional humanitario (DIH) y los instrumentos de derechos humanos por parte de estas empresas, cuya presencia en este ámbito es relativamente reciente. Es grato al CICR participar en este proyecto.

¿A quién atañe la iniciativa y cuáles son sus objetivos?
Ésta es una iniciativa de un Estado dirigida a los Estados, aunque los representantes de la industria pueden hacer una contribución importantísima, por eso también han sido consultados, así como un reducido número de expertos.

Obviamente, incumbe a los Estados decidir cómo van a proceder. Nosotros quisiéramos que, como mínimo, se confirmen y reconozcan plenamente las responsabilidades de los Estados, de las EMP/ESP y de su personal, de conformidad con el derecho internacional.

También sería muy útil que se elabore un documento que sirva de orientación a los Estados en sus relaciones con las EMP/ESP. En dicho documento se podrían sugerir medidas, basadas en prácticas idóneas, que los Estados podrían adoptar para fomentar un mayor respeto del DIH y de los derechos humanos, bien al contratar a las EMP/ESP, bien cuando estas empresas operen en su territorio, o cuando las EMP/ESP con sede en su territorio exporten servicios militares y de seguridad al extranjero.

En este documento se podría plantear la posibilidad de aprobar un marco normativo nacional por el que se proporcione una base jurídica sólida para abordar la cuestión.

¿Cuáles son los pasos siguientes?
En enero de 2006, se celebraron dos reuniones intergubernamentales en las que se reunieron expertos de Estados con experiencia en este ámbito, así como un pequeño grupo de representantes de la industria y otros expertos. Las reacciones fueron muy positivas y los participantes alentaron a Suiza a proseguir con la iniciativa.

Una tercera reunión intergubernamental está prevista para abril de 2008 a fin de discutir el marco legal existente que rige las actividades de las compañías militares y de seguridad privadas y las responsabilidades de los estados al respecto, así como para realizar recomendaciones a los Estados acerca de cómo implementar en la práctica sus responsabilidades. Suiza aspira a concluir el proceso hacia el final de 2008.

Una cosa es segura: habida cuenta de la probabilidad de que continúe, o incluso aumente, la presencia de las EMP/ESP en las zonas de conflicto, ha llegado el momento de empezar a actuar para que se aprueben medidas normativas.

¿Qué normas son aplicables? ¿Son adecuadas?
Los periodistas, incluso los expertos, suelen afirmar que hay un vacío jurídico por lo que respecta a las EMP/ESP. Para el CICR, en cambio, está claro que en situaciones de conflicto armado sí existe una rama del derecho aplicable, concretamente el DIH, que rige tanto las actividades del personal de las EMP/ESP, como las responsabilidades de los Estados que las contratan.

El derecho también impone obligaciones a los Gobiernos de los países en los que están registradas o se han constituido dichas empresas, así como a los países donde operan.

En caso de infracciones del DIH, la responsabilidad jurídica del personal de las EMP/ESP y de los Estados que las contratan está bastante clara; aunque han surgido algunas dificultades prácticas para incoar procesos judiciales cuando se han cometido violaciones.

Hay ámbitos donde el derecho es insuficiente: el del control nacional o internacional de los servicios que pueden prestar las EMP/ESP y el de los procesos administrativos, si los hay, que las empresas deben respetar para que se les permita operar. No hay un marco normativo internacional que se centre específicamente en esta industria y en sus actividades.

Sólo unos pocos Estados han aprobado una legislación por la que se establecen concretamente los procedimientos que han de aplicar las EMP/ESP con sede en su territorio, a fin de obtener la autorización para operar en el extranjero (Sudáfrica), o por la que se regule el funcionamiento de las empresas que operan en el respectivo territorio (Irak, Sierra Leona).

Por último, no debemos olvidar que la ley también está hecha para proteger al personal de estas empresas, aunque con algunas condiciones. La protección a la que tienen derecho dependerá del tipo de actividad que desempeñen.

Esta iniciativa, ¿no refleja más bien el deseo de los abogados de regularlo todo?
¡En absoluto! Las EMP/ESP intervienen cada vez más en situaciones que les ponen en contacto directo con personas vulnerables que están protegidas por los Convenios de Ginebra, como, por ejemplo, en Irak. Es, pues, fundamental que conozcan y respeten el derecho; de hecho algunas EMP/ESP han pedido que se aclaren las normas y el derecho, y han acogido favorablemente esta iniciativa. Reitero: la iniciativa no pretende introducir nuevas normas sino reafirmar el derecho internacional existente y dar a los Estados una orientación en sus relaciones con las EMP/ESP.

La tercerización de funciones militares

Antecedentes

El reciente aumento en la tercerización de funciones militares ha puesto al personal de las compañías militares y de seguridad privadas (CMP/CSP) en contacto directo con personas protegidas en virtud del derecho humanitario internacional, como las que están privadas de libertad y la población civil en general.

Durante los últimos 15 años, los Estados han estado suscribiendo contratos con CMP/CSP para la realización de un número cada vez mayor de funciones que anteriormente estaban a cargo de sus propios sistemas militares o de seguridad. Se incluyen entre ellas el apoyo logístico para despliegues y operaciones militares, el mantenimiento de sistemas de armamento, la protección de locales e instalaciones, los servicios de escolta, la instrucción de las fuerzas militares y policiales, tanto en el país como en el exterior, la recopilación y el análisis de datos de los servicios de información, la custodia y el interrogatorio de detenidos, y en algunas ocasiones, la participación en combates. Estos acontecimientos también plantean cuestiones con respecto a la protección del personal de las CMP/CSP en el marco del DIH.

En los últimos años, se ha registrado un incremento inédito en la demanda de servicios militares y de seguridad privados, a la que han respondido tanto compañías estructuradas, con antecedentes en la prestación de servicios militares y de seguridad, como numerosas compañías nuevas.

No sólo los Estados, sino también las empresas comerciales, las organizaciones internacionales y regionales y las organizaciones no gubernamentales recurren a los servicios de seguridad privados, sobre todo cuando realizan actividades en situaciones de conflicto armado.

En términos generales, los especialistas del sector de la seguridad coinciden en que las CMP/CSP continuarán formando parte del entorno de dicho sector en el futuro previsible.

Algunas cuestiones que se plantean desde la perspectiva del CICR

La aplicación del Derecho Internacional Humanitario (DIH)

Aunque se diga con frecuencia que, en el derecho, hay un vacío en lo que respecta a las CMP/CSP, en situaciones de conflicto armado el DIH rige tanto las actividades del personal de esas compañías como las responsabilidades de los Estados que las contratan. Es cierto que algunas preguntas no tienen respuestas sencillas. Por ejemplo, con respecto al estatuto de los miembros del personal de las CMP/CSP en el marco del DIH: ¿son combatientes o civiles?

A menos que formen parte de las fuerzas armadas de un Estado, los miembros del personal de las CMP/CSP son personas civiles, y como tales, no deben ser objeto de ataques. Pero si realizan actividades que equivalen a participar directamente en las hostilidades, pierden la protección contra los ataques. En cualquier caso, deben respetar las normas del derecho internacional humanitario. El DIH no reglamenta el estatuto de las compañías en sí.

Distinción entre civiles y combatientes

Cada vez más, se recurre a nuevos actores que, en ciertas circunstancias, a los ojos de los observadores y de las personas que realizan actividades en el terreno, no son claramente civiles ni claramente combatientes. Esta situación conlleva el riesgo de difuminar la diferencia entre esas dos categorías de personas, que es fundamental en el DIH y para las operaciones humanitarias.

El deber de respetar y hacer respetar el DIH

La inquietud principal del CICR es que estas nuevas entidades respeten el DIH en situaciones de conflicto armado. Para lograr ese objetivo, es necesario que se cumplan, como mínimo, las siguientes condiciones:

El personal de las CMP/CSP debe tener conocimiento del marco jurídico en el que se desempeñan, con inclusión del DIH.
En las operaciones que realicen, deben respetar las normas del DIH. Esto significa que las reglas de enfrentamiento y los procedimientos operativos estándar deben ser conformes a lo dispuesto por el DIH.
Han de existir mecanismos eficaces para que las CMP/CSP y su personal respondan de cualquier violación del DIH.
Las medidas necesarias para satisfacer estas condiciones deben ser adoptadas por las propias compañías y por los Estados que las contratan, por los Estados en cuyo territorio están constituidas y por los Estados donde actúan. Las últimas dos situaciones podrían solucionarse mediante la adopción de un marco jurídico. Hasta ahora, sólo unos pocos Estados han adoptado disposiciones jurídicas en las que se establecen procedimientos que las CMP/CSP constituidas en su territorio deben observar para que se les permita actuar en el exterior. Igualmente escasos son los Estados que han reglamentado el funcionamiento de las compañías en sus propios territorios.

Responsabilidad de mando

Las fuerzas armadas de los Estados cuentan con una amplia variedad de medidas correctivas no judiciales y administrativas, así como con el propio derecho militar. Esas disposiciones ayudan a los oficiales a mantener la disciplina, el respeto del DIH y el mando y control efectivos de las tropas.

Junto con dichas herramientas de mando, el sistema también establece la posible responsabilidad penal de un oficial al mando que haya omitido prevenir o reprimir las violaciones del DIH cometidas por sus tropas, que conocía o debía conocer.

El concepto del mando responsable es un instrumento poderoso para prevenir violaciones del DIH por parte de los soldados durante las operaciones militares. No se ha elucidado en qué medida es posible aplicar un sistema similar con respecto a las CMP/CSP.

La política del CICR con respecto a las CMP/CSP

Cuando un Estado subcontrata funciones militares y/o de seguridad, mantiene su responsabilidad en el marco del DIH. El CICR ha iniciado un diálogo sobre la cuestión de las CMP/CSP con algunos Estados, en particular con aquellos que contratan CMP/CSP y aquellos en cuyo territorio operan o se han constituido compañías de ese tipo. Los primeros pasos en este diálogo han sido alentadores. Los objetivos son asegurar que los Estados ejerzan sus responsabilidades con respecto a las operaciones de las CMP/CSP y alentarlos a que adopten medidas apropiadas a fin de garantizar el respeto del derecho internacional humanitario.

En paralelo, el CICR ha iniciado un diálogo con representantes del sector de las CMP/CSP. El objetivo es mejorar la protección y la ayuda prestadas a las personas afectadas por conflictos armados, así como promover el DIH. Más concretamente, el CICR desea procurar que las CMP/CSP y su personal respeten el DIH y que conozcan y comprendan el cometido, las actividades y el modus operandi del CICR.

Las compañías militares y de seguridad privadas "reconocen las obligaciones dimanantes del derecho humanitario"

¿Qué acciones concretas ha realizado el CICR para incitar a los portadores de armas a respetar el DIH?

Las fuerzas armadas deben respetar el derecho internacional humanitario (DIH) en todo momento; se supone que estudian ese derecho a lo largo de su formación. El CICR ayuda a los Estados a asumir esa responsabilidad, en particular pone sus expertos a disposición para que los ayuden a elaborar programas de formación en DIH o en derecho de los conflictos armados, como suelen llamarlo.

Además, presta ese apoyo para la formación de los servicios de policía y de otras fuerzas de seguridad que intervienen en situaciones donde la población civil puede estar en peligro. Entre los grupos destinatarios de esas actividades, se cuentan los grupos armados organizados que participan en conflictos armados no internacionales, pues ellos también están vinculados por el DIH.

Las actividades del CICR tienen una finalidad muy práctica: tratar de prevenir las violaciones del derecho, a fin de mejorar la seguridad de los civiles, los heridos, los prisioneros, y de garantizar a las organizaciones humanitarias un acceso más seguro a las víctimas.

El CICR dialoga desde 2004 con las compañías militares y de seguridad privadas. ¿Cuál es la finalidad de ese diálogo?

El CICR desea entablar un diálogo con todas las instituciones y las personas que pueden tener influencia en los conflictos armados y su conducción, sobre todo con los portadores de armas. La tendencia creciente a confiar tareas militares a empresas especializadas ha hecho que un número mayor de colaboradores de esas compañías estén en contacto directo con personas protegidas por el derecho internacional humanitario, en particular con los civiles, y los prisioneros o detenidos. Por consiguiente, el CICR debe seguir manteniendo el diálogo con esas organizaciones.

La finalidad es, principalmente, mejorar la protección y la asistencia que se presta a las personas afectadas por conflictos armados y promover el DIH. Más específicamente, el CICR procura lograr que las compañías militares y de seguridad privadas, así como sus empleados, respeten el DIH, y conozcan y comprendan el cometido, las actividades y las modalidades de trabajo del CICR.

El jefe de una compañía militar y de seguridad privada declaró públicamente que ese tipo de compañías deben respetar los Convenios de Ginebra. ¿Otros directivos también lo han hecho?

Los inicios del diálogo fueron alentadores. Tanto los Estados como las compañías militares y de seguridad privadas estaban abiertos al diálogo con el CICR.

Los Estados que emplean compañías de seguridad privadas de ese tipo comprenden que esa tercerización de las tareas militares y de seguridad no los exime de sus obligaciones dimanantes del DIH. Esas compañías también reconocieron que tienen obligaciones en virtud del derecho internacional humanitario. En realidad, son muchas las que piden cierta reglamentación de sus actividades por parte del Estado.

¿Cuáles son las principales preocupaciones del CICR con respecto a las actividades de las compañías militares y de seguridad privadas?
Nuestra principal preocupación es que respeten el DIH. También nos preocupa el hecho de que el recurso creciente a los guardias privados puede erosionar la distinción fundamental entre civiles y combatientes, pues a veces no se sabe a cuál de esas dos categorías pertenecen esas personas. En el DIH, esa diferenciación es capital, tanto para la conducción de las operaciones militares, como para la labor humanitaria en el terreno.

Otra cuestión importante es determinar en qué medida las compañías militares y de seguridad privadas cuentan con sistemas de mando y de control, como los que tienen las fuerzas armadas regulares. Y si no los tienen, saber qué influencia ello tiene en la conducta de los agentes privados.

¿Cómo ve el futuro? ¿Los delegados del CICR van a dar cursos al personal de las compañías militares y de seguridad privadas?
Dispensar una enseñanza sobre el contenido y la aplicación del DIH a los empleados de las compañías militares y de seguridad privadas es una responsabilidad que incumbe esencialmente a las compañías mismas y a los Estados que las emplean.

De ninguna manera el CICR debe reemplazar a la compañía o al Estado, pero estamos dispuestos a dialogar sobre la posibilidad de asesorarlos sobre la manera de cumplir esa responsabilidad.

Las acciones de las compañías militares y de seguridad privadas en Irak y en otras zonas de conflicto han alimentado un debate sobre sus responsabilidades ante la ley.
Un experto del CICR explica cómo se aplica el derecho de la guerra (o derecho internacional humanitario) a estas compañías y su personal y cuáles son los esfuerzos realizados para asegurar que respeten sus obligaciones legales.

¿Qué es el derecho internacional humanitario (DIH)?

Es la rama del derecho internacional que se aplica en tiempo de conflicto armado y que:

protege a las personas que no participan o que han dejado de participar directamente en las hostilidades, y
reglamenta los medios y los métodos de guerra permisibles.

¿Quién está obligado por el derecho internacional humanitario?

Todos los que se encuentran en situaciones de conflicto armado: los Estados, los grupos armados organizados, las fuerzas multinacionales, los civiles y el personal de las compañías militares y de seguridad privadas ("CMSP").

¿Cuál es el estatuto del personal de las CMP/CSP en virtud del derecho internacional humanitario?

A menos que formen parte de las fuerzas armadas de un Estado o cumplan funciones de combate para un grupo armado organizado que pertenece a una de las partes en el conflicto, los miembros del personal de las empresas militares y de seguridad privadas son civiles. Por lo tanto,

no pueden ser objeto de ataques, y
no pueden participar directamente en las hostilidades.

Sin embargo, si los miembros del personal de las CMSP realizan actos equivalentes a la participación directa en las hostilidades,

durante dicha participación, pierden la protección contra los ataques, y
si son capturados, pueden ser enjuiciados por su mera participación en las hostilidades, aunque no hayan cometido violaciones del derecho internacional humanitario.

¿Se puede considerar que las empresas militares y de seguridad privadas son mercenarios modernos?

Para ser mercenarios, los empleados de una empresa militar o de seguridad privada deben satisfacer criterios tan numerosos, que la mayoría de ellos no responde a la definición de ese término. Por empezar, ningún ciudadano de las partes en el conflicto puede ser un mercenario. Por otra parte, debe emplearse a la persona con el fin de que participe directamente en las hostilidades, y además, la persona debe estar haciendo precisamente eso para satisfacer la definición de mercenario.

Si un Estado ha ratificado la Convención de las Naciones Unidas o la Convención de la Organización de la Unidad Africana contra el mercenarismo, o ambas, tiene la obligación de enjuiciar y sancionar a los mercenarios. Desde la perspectiva del derecho humanitario, la única consecuencia jurídica de ser un mercenario es que los mercenarios no tienen derecho al estatuto de prisionero de guerra cuando participan en un conflicto armado internacional. Sin embargo, sí tienen derecho a gozar de condiciones de detención adecuadas y a ser sometidos un juicio imparcial.

¿Qué medidas pueden adoptar las CMSP para asegurar que su personal respete el derecho internacional humanitario?

Si están actuando en situaciones de conflicto armado, el personal de las CMSP debe respetar el derecho internacional humanitario y asumir responsabilidad penal por las infracciones que cometan. Este principio se aplica independientemente de si la parte que contrata a la CMSP es un Estado, una organización internacional o una compañía privada.

A fin de asegurar que el personal de las CMSP respete el derecho internacional humanitario, es fundamental adoptar, tanto antes como durante el despliegue, ciertas medidas como las que se enumeran a continuación:

Verificar los procedimientos de contratación de personal.
Impartir una formación adecuada en derecho internacional humanitario.
Aplicar procedimientos operativos estándar y reglas de enfrentamiento que sean conformes al derecho internacional humanitario.
Adoptar procedimientos de disciplina interna.

¿Cuál es la responsabilidad de los Estados con respecto a las CMSP que contratan?

Los Estados no pueden liberarse de las obligaciones que les impone el derecho internacional humanitario mediante la contratación de CMSP. Siguen siendo responsables de velar por que se cumplan las normas pertinentes.

Si el personal de una CMSP comete violaciones del derecho internacional humanitario, la responsabilidad recaerá no sólo en la compañía y su personal, sino también en el Estado que la haya contratado.

Los Estados deben velar por que el personal de esas compañías respete el derecho internacional humanitario. Algunas medidas importantes para lograr dicho objetivo son las siguientes:

exigir que se imparta al personal una formación adecuada en derecho internacional humanitario, y
exigir que las reglas de enfrentamiento y los procedimientos operativos estándar de las compañías sean conformes al derecho internacional humanitario.

Además, los Estados deben adoptar los mecanismos necesarios para que el personal de las CMSP sospechado de violar el derecho internacional humanitario y, posiblemente, las propias CMSP, en juicios civiles, rindan cuenta de sus acciones.

¿Cuál es la responsabilidad de los Estados en cuyo territorio se constituyen o realizan operaciones las CMSP?

Todos los Estados tienen la responsabilidad de respetar y hacer respetar el derecho internacional humanitario, incluso por el personal de las CMSP. Los Estados en cuyo territorio se constituyen o realizan operaciones las CMSP se encuentran en una posición especialmente favorable para influir en el comportamiento de éstas.

Una de las formas en que el Estado donde se registran o actúan dichas compañías puede ejercer un cierto nivel de control y de supervisión es establecer un sistema de autorización y de reglamentación. Los elementos clave de un posible marco reglamentario nacional podrían ser, entre otros, los siguientes:

La prohibición de realizar ciertas actividades (por ejemplo, la participación directa en las hostilidades, a menos que el personal de las CMP/CSP se incorpore en las fuerzas armadas).
El requisito de que las CMSP obtengan autorizaciones de funcionamiento basadas en el cumplimiento de determinados criterios, por ejemplo que las compañías:
- impartan formación en DIH a su personal;
- adopten procedimientos operativos estándar y reglas de enfrentamiento que sean conformes a los principios del DIH;
- adopten medidas disciplinarias apropiadas.
El requisito de autorizar cada contrato, lo que dependería de la índole de las actividades propuestas y de la situación imperante en el país donde la compañía realizaría sus actividades.
Sanciones por realizar operaciones sin haber obtenido las autorizaciones necesarias o por actuar en violación de las mismas (por ejemplo, el retiro de la autorización de funcionamiento, pérdida de la garantía, sanciones penales, etc.).

El sistema reglamentario debería complementarse mediante un sistema que permita enjuiciar a las personas acusadas de haber cometido violaciones del derecho internacional humanitario.

Privatización de la guerra: presencia cada vez mayor de compañías militares y de seguridad privadas

En esta sección, se analiza la presencia cada vez mayor de compañías militares y de seguridad privada en zonas de conflicto; las consecuencias que ello tiene para la población civil y otras categorías de personas protegidas por los Convenios de Ginebra, así como para las actividades humanitarias; la posición de esas compañías en el derecho internacional humanitario.

Desde los años 1990, se suele subcontratar a compañías militares o de seguridad privadas para desempeñar muchas de las funciones que tradicionalmente cumplían las fuerzas militares o de seguridad oficiales de los Estados. Esas actividades abarcan tareas de seguridad, apoyo logístico y técnico, entrenamiento y protección personal.

Pero también se contrata a esas empresas para cumplir tareas de inteligencia y análisis, custodia e interrogatorio de prisioneros y, en algunos casos, para participar en las hostilidades.

Esas actividades hacen que las compañías militares y de seguridad privadas estén en contacto directo con las personas protegidas por el derecho internacional humanitario. El CICR está ampliando sus contactos con esas compañías, así como con los Gobiernos correspondientes, a fin de hacer todo lo posible para que esos actores tengan pleno conocimiento de las responsabilidades que les incumben en virtud del derecho internacional humanitario.

Each State Party undertakes to destroy or ensure the destruction of all anti-personnel mines in mined areas under its jurisdiction or control, as soon as possible but not later than ten years after the entry into force of this Convention for that State Party. Each State Party shall make every effort to identify all areas under its jurisdiction or control in which anti-personnel mines are known or suspected to be emplaced and shall ensure as soon as possible that all anti-personnel mines in mined areas under its jurisdiction or control are perimeter-marked, monitored and protected by fencing or other means, to ensure the effective exclusion of civilians, until all anti-personnel mines contained therein have been destroyed. If a State Party believes that it will be unable to destroy or ensure the destruction of all anti-personnel mines referred to in paragraph 1 within that time period, it may submit a request to a Meeting of the States Parties or a Review Conference for an extension of the deadline for completing the destruction of such anti-personnel mines, for a period of up to ten years. 5. 5. The Meeting of the States Parties or the Review Conference shall, taking into consideration the factors contained in paragraph 4, assess the request and decide by a majority of votes of States Parties present and voting whether to grant the request for an extension period. 1. 1. In fulfilling its obligations under this Convention each State Party has the right to seek and receive assistance, where feasible, from other States Parties to the extent possible. States Parties may request the United Nations, regional organizations, other States Parties or other competent intergovernmental or non-governmental fora to assist its authorities in the elaboration of a national demining program to determine, inter alia: Los Estados Partes podrán solicitar a las Naciones Unidas, las organizaciones regionales, otros Estados Partes o de otra índole competentes intergubernamentales o no gubernamentales foros para ayudar a sus autoridades en la elaboración de un programa nacional de desminado a fin de determinar, entre otras cosas:

8. 8. Each State Party giving and receiving assistance under the provisions of this Article shall cooperate with a view to ensuring the full and prompt implementation of agreed assistance programs. 1. 1. 2. 2. The information provided in accordance with this Article shall be updated by the States Parties annually, covering the last calendar year, and reported to the Secretary-General of the United Nations not later than 30 April of each year. Article 8 Artículo 8
Facilitation and clarification of compliance Facilitación y aclaración de cumplimiento

1. 1. The States Parties agree to consult and cooperate with each other regarding the implementation of the provisions of this Convention, and to work together in a spirit of cooperation to facilitate compliance by States Parties with their obligations under this Convention. If one or more States Parties wish to clarify and seek to resolve questions relating to compliance with the provisions of this Convention by another State Party, it may submit, through the Secretary-General of the United Nations, a Request for Clarification of that matter to that State Party. 3. 3. If the requesting State Party does not receive a response through the Secretary-General of the United Nations within that time period, or deems the response to the Request for Clarification to be unsatisfactory, it may submit the matter through the Secretary-General of the United Nations to the next Meeting of the States Parties. 4. 4. Pending the convening of any meeting of the States Parties, any of the States Parties concerned may request the Secretary-General of the United Nations to exercise his or her good offices to facilitate the clarification requested. 5. 5. The requesting State Party may propose through the Secretary-General of the United Nations the convening of a Special Meeting of the States Parties to consider the matter. 6. 6. The Meeting of the States Parties or the Special Meeting of the States Parties, as the case may be, shall first determine whether to consider the matter further, taking into account all information submitted by the States Parties concerned. 7. 7. All States Parties shall cooperate fully with the Meeting of the States Parties or the Special Meeting of the States Parties in the fulfilment of its review of the matter, including any fact-finding missions that are authorized in accordance with paragraph 8. If further clarification is required, the Meeting of the States Parties or the Special Meeting of the States Parties shall authorize a fact-finding mission and decide on its mandate by a majority of States Parties present and voting. The Secretary-General of the United Nations shall prepare and update a list of the names, nationalities and other relevant data of qualified experts provided by States Parties and communicate it to all States Parties. 10. 10. Upon receiving a request from the Meeting of the States Parties or a Special Meeting of the States Parties, the Secretary-General of the United Nations shall, after consultations with the requested State Party, appoint the members of the mission, including its leader. 11. 11. Upon at least 72 hours notice, the members of the fact-finding mission shall arrive in the territory of the requested State Party at the earliest opportunity. 13. 13. The requested State Party shall make all efforts to ensure that the fact-finding mission is given the opportunity to speak with all relevant persons who may be able to provide information related to the alleged compliance issue. The requested State Party shall grant access for the fact-finding mission to all areas and installations under its control where facts relevant to the compliance issue could be expected to be collected. In the event that the requested State Party makes such arrangements, it shall make every reasonable effort to demonstrate through alternative means its compliance with this Convention. 15. 15. The fact-finding mission may remain in the territory of the State Party concerned for no more than 14 days, and at any particular site no more than 7 days, unless otherwise agreed. 16. 16. All information provided in confidence and not related to the subject matter of the fact-finding mission shall be treated on a confidential basis. The fact-finding mission shall report, through the Secretary-General of the United Nations, to the Meeting of the States Parties or the Special Meeting of the States Parties the results of its findings. 18. 18. The Meeting of the States Parties or the Special Meeting of the States Parties shall consider all relevant information, including the report submitted by the fact-finding mission, and may request the requested State Party to take measures to address the compliance issue within a specified period of time. 19. 19. The Meeting of the States Parties or the Special Meeting of the States Parties may suggest to the States Parties concerned ways and means to further clarify or resolve the matter under consideration, including the initiation of appropriate procedures in conformity with international law. Each State Party shall take all appropriate legal, administrative and other measures, including the imposition of penal sanctions, to prevent and suppress any activity prohibited to a State Party under this Convention undertaken by persons or on territory under its jurisdiction or control. Settlement of disputes Solución de controversias

1. 1. The States Parties shall consult and cooperate with each other to settle any dispute that may arise with regard to the application or the interpretation of this Convention. The Meeting of the States Parties may contribute to the settlement of the dispute by whatever means it deems appropriate, including offering its good offices, calling upon the States parties to a dispute to start the settlement procedure of their choice and recommending a time-limit for any agreed procedure. Article 11 Artículo 11
Meetings of the States Parties Reuniones de los Estados Partes

1. 1. 2. 2. The First Meeting of the States Parties shall be convened by the Secretary-General of the United Nations within one year after the entry into force of this Convention. 1. 1. A Review Conference shall be convened by the Secretary-General of the United Nations five years after the entry into force of this Convention. 3. 3. The Amendment Conference shall be held immediately following a Meeting of the States Parties or a Review Conference unless a majority of the States Parties request that it be held earlier. This Convention, done at Oslo, Norway, on 18 September 1997, shall be open for signature at Ottawa, Canada, by all States from 3 December 1997 until 4 December 1997, and at the United Nations Headquarters in New York from 5 December 1997 until its entry into force.

Article 16
Ratification, acceptance, approval or accession

1. 1. This Convention is subject to ratification, acceptance or approval of the Signatories.

2. 2. It shall be open for accession by any State which has not signed the Convention.

3. 3. The instruments of ratification, acceptance, approval or accession shall be deposited with the Depositary.

Article 17
Entry into force

1. 1. This Convention shall enter into force on the first day of the sixth month after the month in which the 40th instrument of ratification, acceptance, approval or accession has been deposited.

2. 2. For any State which deposits its instrument of ratification, acceptance, approval or accession after the date of the deposit of the 40th instrument of ratification, acceptance, approval or accession, this Convention shall enter into force on the first day of the sixth month after the date on which that State has deposited its instrument of ratification, acceptance, approval or accession.

Article 18
Provisional application

Any State may at the time of its ratification, acceptance, approval or accession, declare that it will apply provisionally paragraph 1 of Article 1 of this Convention pending its entry into force.

Article 19
Reservations

The Articles of this Convention shall not be subject to reservations.

Article 20
Duration and withdrawal

1. 1. This Convention shall be of unlimited duration.

2. 2. Each State Party shall, in exercising its national sovereignty, have the right to withdraw from this Convention. It shall give notice of such withdrawal to all other States Parties, to the Depositary and to the United Nations Security Council. Such instrument of withdrawal shall include a full explanation of the reasons motivating this withdrawal.

3. 3. Such withdrawal shall only take effect six months after the receipt of the instrument of withdrawal by the Depositary. If, however, on the expiry of that six- month period, the withdrawing State Party is engaged in an armed conflict, the withdrawal shall not take effect before the end of the armed conflict.

4. 4. The withdrawal of a State Party from this Convention shall not in any way affect the duty of States to continue fulfilling the obligations assumed under any relevant rules of international law.

Article 21
Depositary

The Secretary-General of the United Nations is hereby designated as the Depositary of this Convention.

The original of this Convention, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.

This Convention and its annexed Protocols shall apply in the situations referred to in Article 2 common to the Geneva Conventions of 12 August 1949 for the Protection of War Victims, including any situation described in paragraph 4 of Article 1 of Additional Protocol I to these Conventions. Nothing in this Convention or its annexed Protocols shall be interpreted as detracting from other obligations imposed upon the High Contracting Parties by international humanitarian law applicable in armed conflict. 1. 1. This Convention shall enter into force six months after the date of deposit of the twentieth instrument of ratification, acceptance, approval or accession. Dissemination Difusión

The High Contracting Parties undertake, in time of peace as in time of armed conflict, to disseminate this Convention and those of its annexed Protocols by which they are bound as widely as possible in their respective countries and, in particular, to include the study thereof in their programmes of military instruction, so that those instruments may become known to their armed forces. 1. 1. When one of the parties to a conflict is not bound by an annexed Protocol, the parties bound by this Convention and that annexed Protocol shall remain bound by them in their mutual relations. The High Contracting Party and the authority may also agree to accept and apply the obligations of Additional Protocol I to the Geneva Conventions on a reciprocal basis. (a) If, after a period of ten years following the entry into force of this Convention, no conference has been convened in accordance with subparagraph 1 (a) or 2 (a) of this Article, any High Contracting Party may request the Depositary to convene a conference to which all High Contracting Parties shall be invited to review the scope and operation of this Convention and the Protocols annexed thereto and to consider any proposal for amendments of this Convention or of the existing Protocols. 1. 1. Any High Contracting Party may denounce this Convention or any of its annexed Protocols by so notifying the Depositary. Toda Alta Parte Contratante podrá denunciar la presente Convención o de cualquiera de sus Protocolos anexos mediante notificación por el Depositario.
2. 2. Any such denunciation shall only take effect one year after receipt by the Depositary of the notification of denunciation. If, however, on the expiry of that year the denouncing High Contracting Party is engaged in one of the situations referred to in Article 1, the Party shall continue to be bound by the obligations of this Convention and of the relevant annexed Protocols until the end of the armed conflict or occupation and, in any case, until the termination of operations connected with the final release, repatriation or re-establishment of the person protected by the rules of international law applicable in armed conflict, and in the case of any annexed Protocol containing provisions concerning situations in which peace-keeping, observation or similar functions are performed by United Nations forces or missions in the area concerned, until the termination of those functions. 3. 3. Any denunciation of this Convention shall be considered as also applying to all annexed Protocols by which the denouncing High Contracting Party is bound. The High Contracting Parties undertake to prepare in time of peace for the safeguarding of cultural property situated within their own territory against the foreseeable effects of an armed conflict, by taking such measures as they consider appropriate. The High Contracting Parties undertake to respect cultural property situated within their own territory as well as within the territory of other High Contracting Parties by refraining from any use of the property and its immediate surroundings or of the appliances in use for its protection for purposes which are likely to expose it to destruction or damage in the event of armed conflict; and by refraining from any act of hostility directed against such property. 3. 3. The High Contracting Parties further undertake to prohibit, prevent and, if necessary, put a stop to any form of theft, pillage or misappropriation of, and any acts of vandalism directed against, cultural property. No High Contracting Party may evade the obligations incumbent upon it under the present Article, in respect of another High Contracting Party, by reason of the fact that the latter has not applied the measures of safeguard referred to in Article 3. Any High Contracting Party in occupation of the whole or part of the territory of another High Contracting Party shall as far as possible support the competent national authorities of the occupied country in safeguarding and preserving its cultural property. 2. 2. Should it prove necessary to take measures to preserve cultural property situated in occupied territory and damaged by military operations, and should the competent national authorities be unable to take such measures, the Occupying Power shall, as far as possible, and in close co-operation with such authorities, take the most necessary measures of preservation. Any High Contracting Party whose government is considered their legitimate government by members of a resistance movement, shall, if possible, draw their attention to the obligation to comply with those provisions of the Conventions dealing with respect for cultural property. The High Contracting Parties undertake to introduce in time of peace into their military regulations or instructions such provisions as may ensure observance of the present Convention, and to foster in the members of their armed forces a spirit of respect for the culture and cultural property of all peoples. The High Contracting Parties undertake to plan or establish in peacetime, within their armed forces, services or specialist personnel whose purpose will be to secure respect for cultural property and to co-operate with the civilian authorities responsible for safeguarding it. 2. 2. A refuge for movable cultural property may also be placed under special protection, whatever its location, if it is so constructed that, in all probability, it will not be damaged by bombs. 3. 3. A centre containing monuments shall be deemed to be used for military purposes whenever it is used for the movement of military personnel or material, even in transit. If any cultural property mentioned in paragraph I of the present Article is situated near an important military objective as defined in the said paragraph, it may nevertheless be placed under special protection if the High Contracting Party asking for that protection undertakes, in the event of armed conflict, to make no use of the objective and particularly, in the case of a port, railway station or aerodrome, to divert all traffic therefrom. 6. 6. Special protection is granted to cultural property by its entry in the "International Register of Cultural Property under Special Protection". The High Contracting Parties undertake to ensure the immunity of cultural property under special protection by refraining, from the time of entry in the International Register, from any act of hostility directed against such property and, except for the cases provided for in paragraph 5 of Article 8, from any use of such property or its surroundings for military purposes. During an armed conflict, cultural property under special protection shall be marked with the distinctive emblem described in Article 16, and shall be open to international control as provided for in the Regulations for the execution of the Convention. If one of the High Contracting Parties commits, in respect of any item of cultural property under special protection, a violation of the obligations under Article 9, the opposing Party shall, so long as this violation persists, be released from the obligation to ensure the immunity of the property concerned. Apart from the case provided for in paragraph I of the present Article, immunity shall be withdrawn from cultural property under special protection only in exceptional cases of unavoidable military necessity, and only for such time as that necessity continues. The Party withdrawing immunity shall, as soon as possible, so inform the Commissioner-General for cultural property provided for in the Regulations for the execution of the Convention, in writing, stating the reasons. Transport exclusively engaged in the transfer of cultural property, whether within a territory or to another territory, may, at the request of the High Contracting Party concerned, take place under special protection in accordance with the conditions specified in the Regulations for the execution of the Convention. If a High Contracting Party considers that the safety of certain cultural property requires its transfer and that the matter is of such urgency that the procedure laid down in Article 12 cannot be followed, especially at the beginning of an armed conflict, the transport may display the distinctive emblem described in Article 16, provided that an application for immunity referred to in Article 12 has not already been made and refused. As far as is consistent with the interests of security, personnel engaged in the protection of cultural property shall, in the interests of such property, be respected and, if they fall into the hands of the opposing Party, shall be allowed to continue to carry out duties whenever the cultural property for which they are responsible has also fallen into the hands of the opposing Party. The distinctive emblem of the Convention shall take the form of a shield, pointed below, per saltire blue and white (a shield consisting of a royal-blue square, one of the angles of which forms the point of the shield, and of a royal-blue triangle above the square, the space on either side being taken up by a white triangle). During an armed conflict, the use of the distinctive emblem in any other cases than those mentioned in the preceding paragraphs of the present Article, and the use for any purpose whatever of a sign resembling the distinctive emblem, shall be forbidden. Apart from the provisions which shall take effect in time of peace, the present Convention shall apply in the event of declared war or of any other armed conflict which may arise between two or more of the High Contracting Parties, even if the state of war is not recognized by one or more of them. 2. 2. The parties to the Conflict shall endeavour to bring into force, by means of special agreements, all or part of the other provisions of the present Convention. Art. Art. 20. 20. The procedure by which the present Convention is to be applied is defined in the Regulations for its execution, which constitute an integral part thereof. The High Contracting Parties may call upon the United Nations Educational, Scientific and Cultural Organization for technical assistance in organizing the protection of their cultural property, or in connexion with any other problem arising out of the application of the present Convention or the Regulations for its execution. The High Contracting Parties undertake, in time of peace as in time of armed conflict, to disseminate the text of the present Convention and the Regulations for its execution as widely as possible in their respective countries. The High Contracting Parties shall communicate to one another, through the Director-General of the United Nations Educational, Scientific and Cultural Organization, the official translations of the present Convention and of the Regulations for its execution. The High Contracting Parties undertake to take, within the framework of their ordinary criminal jurisdiction, all necessary steps to prosecute and impose penal or disciplinary sanctions upon those persons, of whatever nationality, who commit or order to be committed a breach of the present Convention. 2. 2. Thereafter, it shall enter into force, for each High Contracting Party, three months after the deposit of its instrument of ratification or accession. 3. 3. The situations referred to in Articles 18 and 19 shall give immediate effect to ratifications or accessions deposited by the Parties to the conflict either before or after the beginning of hostilities or occupation. Art. Art. 34. 34. 1. 1. Each State Party to the Convention on the date of its entry into force shall take all necessary measures to ensure its effective application within a period of six months after such entry into force. In the relations between Powers which are bound by the Conventions of The Hague concerning the Laws and Customs of War on Land (IV) and concerning Naval Bombardment in Time of War (IX), whether those of 29 July 1899 or those of 18 October 1907, and which are Parties to the present Convention, this last Convention shall be supplementary to the aforementioned Convention (IX) and to the Regulations annexed to the aforementioned Convention (IV) and shall substitute for the emblem described in Article 5 of the aforementioned Convention (IX) the emblem described in Article 16 of the Present Convention, in cases in which the present Convention and the Regulations for its execution provide for the use of this distinctive emblem. In the relations between Powers which are bound by the Washington Pact of 15 April 1935 for the Protection of Artistic and Scientific Institutions and of Historic Monuments (Roerich Pact) and which are Parties to the present Convention, the latter Convention shall be supplementary to the Roerich Pact and shall substitute for the distinguishing flag described in Article III of the Pact the emblem defined in Article 16 of the present Convention, in cases in which the present Convention and the Regulations for its execution provide for the use of this distinctive emblem. Denunciation Denuncia

Art. Art. 37. 37. 1. 1. Each High Contracting Party may denounce the present Convention, on its own behalf, or on behalf of any territory for whose international relations it is responsible. Art. Art. 39. 39. 1. 1. Any High Contracting Party may propose amendments to the present Convention or the Regulations for its execution. 5. 5. After the entry into force of amendments to the present Convention or to the Regulations for its execution, only the text of the Convention or of the Regulations for its execution thus amended shall remain open for ratification or accession. Registration Registro

Art. Art. 40. 40. In accordance with Article 102 of the Charter of the United Nations, the present Convention shall be registered with the Secretariat of the United Nations at the request of the Director-General of the United Nations Educational, Scientific and Cultural Organization. CHAPTER I : CONTROL CAPÍTULO I: CONTROL

Article 1. Artículo 1. On the entry into force of the Convention, the Director-General of the United Nations Educational, Scientific and Cultural Organization shall compile an international list consisting of all persons nominated by the High Contracting Parties as qualified to carry out the functions of Commissioner-General for Cultural Property. Organization of Control

Art. 2. 2. As soon as any High Contracting Party is engaged in an armed conflict to which Article 18 of the
Convention applies:
(a) It shall appoint a representative for cultural property situated in its territory; if it is in occupation of another territory, it shall appoint a special representative for cultural property situated in that territory;
(b) The Protecting Power acting for each of the Parties in conflict with such High Contracting Party shall appoint delegates accredited to the latter in conformity with Article 3 below;
(c) A Commissioner-General for Cultural Property shall be appointed to such High Contracting Party in accordance with Article 4.

Appointment of Delegates of Protecting Powers

Art. 3. 3. The Protecting Power shall appoint its delegates from among the members of its diplomatic or consular staff or, with the approval of the Party to which they will be accredited, from among other persons.

Appointment of Commissioner-General

Art. 4. 4. 1. 1. The Commissioner-General for Cultural Property shall be chosen from the international list of persons by joint agreement between the Party to which he will be accredited and the Protecting Powers acting on behalf of the opposing Parties.
2. 2. Should the Parties fail to reach agreement within three weeks from the beginning of their discussions on this point, they shall request the President of the International Court of Justice to appoint the Commissioner-General, who shall not take up his duties until the Party to which he is accredited has approved his appointment.

Functions of Delegates

Art. 5. 5. The delegates of the Protecting Powers shall take note of violations of the Convention, investigate, with the approval of the Party to which they are accredited, the circumstances in which they have occurred, make representations locally to secure their cessation and, if necessary, notify the Commissioner-General of such violations. They shall keep him informed of their activities.

Functions of the Commissioner-General

Art. 6. 1. 1. The Commissioner-General for Cultural Property shall deal with all matters referred to him in connexion with the application of the Convention, in conjunction with the representative of the Party to which he is accredited and with the delegates concerned.
2. 2. He shall have powers of decision and appointment in the cases specified in the present Regulations.
3. 3. With the agreement of the Party to which he is accredited, he shall have the right to order an investigation or to conduct it himself.
4. 4. He shall make any representations to the Parties to the conflict or to their Protecting Powers which he deems useful for the application of the Convention.
5. 5. He shall draw up such reports as may be necessary on the application of the Convention and communicate them to the Parties concerned and to their Protecting Powers. He shall send copies to the Director-General of the United Nations Educational, Scientific and Cultural Organization, who may make use only of their technical contents.
6. If there is no protecting Power, the Commissioner-General shall exercise the functions of the Protecting Power as laid down in Articles 21 and 22 of the Convention.

Inspectors and Experts

Art. 7. 1. 1. Whenever the Commissioner-General for Cultural Property considers it necessary, either at the request of the delegates concerned or after consultation with them, he shall propose, for the approval of the Party to which he is accredited, an inspector of cultural property to be charged with a specific mission. An inspector shall be responsible only to the Commissioner-General.
2. 2. The Commissioner-General, delegates and inspectors may have recourse to the services of experts, who will also be proposed for the approval of the Party mentioned in the preceding paragraph.

Discharge of the Mission of Control

Art. 8. The Commissioners-General for Cultural Property, delegates of the Protecting Powers, inspectors and experts shall in no case exceed their mandates. In particular, they shall take account of the security needs of the High Contracting Party to which they are accredited and shall in all circumstances act in accordance with the requirements of the military situation as communicated to them by that High Contracting Party.

Substitutes for Protecting Powers

Art. 9. If a Party to the conflict does not benefit or ceases to benefit from the activities of a Protecting Power, a neutral State may be asked to undertake those functions of a Protecting Power which concern the appointment of a Commissioner-General for Cultural Property in accordance with the procedure laid down in Article 4. The Commissioner-General thus appointed shall, if need be, entrust to inspectors the functions of delegates of Protecting Powers as specified in the present Regulations.

Expenses

Art. 10. The remuneration and expenses of the Commissioner-General for Cultural Property, inspectors and experts shall be met by the Party to which they are accredited. Remuneration and expenses of delegates of the Protecting Powers shall be subject to agreement between those Powers and the States whose interests they are safeguarding.

CHAPTER II : SPECIAL PROTECTION

Improvised Refuges

Art. 11. 1. 1. If, during an armed conflict, any High Contracting Party is induced by unforeseen circumstances to set up an improvised refuge and desires that it should be placed under special protection, it shall communicate this fact forthwith to the Commissioner-General accredited to that Party.
2. 2. If the Commissioner-General considers that such a measure is justified by the circumstances and by the importance of the cultural property sheltered in this improvised refuge, he may authorize the High Contracting Party to display on such refuge the distinctive emblem defined in Article 16 of the Convention. He shall communicate his decision without delay to the delegates of the Protecting Powers who are concerned, each of whom may, within a time-limit of 30 days, order the immediate withdrawal of the emblem.
3. 3. As soon as such delegates have signified their agreement or if the time-limit of 30 days has passed without any of the delegates concerned having made an objection, and if, in the view of the Commissioner-General, the refuge fulfils the conditions laid down in Article 8 of the Convention, the Commissioner-General shall request the Director-General of the United Nations Educational, Scientific and Cultural Organization to enter the refuge in the Register of Cultural Property under Special Protection.

International Register of Cultural Property Under Special Protection

Art. 12. 1. 1. An "International Register of Cultural Property under Special Protection" shall be prepared.
2. 2. The Director-General of the United Nations Educational, Scientific and Cultural Organization shall maintain this Register. He shall furnish copies to the Secretary-General of the United Nations and to the High Contracting Parties.
3. 3. The Register shall be divided into sections, each in the name of a High Contracting Party. Each section
shall be sub-divided into three paragraphs, headed: Refuges, Centres containing Monuments, Other Immovable Cultural Property. The Director-General shall determine what details each section shall contain.

Requests for Registration

Art. 13. 1. 1. Any High Contracting Party may submit to the Director-General of the United Nations Educational, Scientific and Cultural Organization an application for the entry in the Register of certain refuges, centres containing monuments or other immovable cultural property situated within its territory. Such application shall contain a description of the location of such property and shall certify that the property complies with the provisions of Article 8 of the Convention.
2. 2. In the event of occupation, the Occupying Power shall be competent to make such application.
3. 3. The Director-General of the United Nations Educational, Scientific and Cultural Organization shall, without delay, send copies of applications for registration to each of the High Contracting Parties.

Objections

Art. 14. 1. 1. Any High Contracting Party may, by letter addressed to the Director-General of the United Nations Educational, Scientific and Cultural Organization, lodge an objection to the registration of cultural property. This letter must be received by him within four months of the day on which he sent a copy of the application for registration.
2. 2. Such objection shall state the reasons giving rise to it, the only valid grounds being that:
(a) the property is not cultural property;
(b) the property does not comply with the conditions mentioned in Article 8 of the Convention.
3. 3. The Director-General shall send a copy of the letter of objection to the High Contracting Parties without delay. He shall, if necessary, seek the advice of the International Committee on Monuments, Artistic and Historical Sites and Archaeological Excavations and also, if he thinks fit, of any other competent organization or person.
4. 4. The Director-General, or the High Contracting Party requesting registration, may make whatever representations they deem necessary to the High Contracting Parties which lodged the objection, with a view to causing the objection to be withdrawn.
5. 5. If a High Contracting Party which has made an application for registration in time of peace becomes involved in an armed conflict before the entry has been made, the cultural property concerned shall at once be provisionally entered in the Register, by the Director-General, pending the confirmation, withdrawal or cancellation of any objection that may be, or may have been, made.
6. If, within a period of six months from the date of receipt of the letter of objection, the Director-General has not received from the High Contracting Party lodging the objection a communication stating that it has been withdrawn, the High Contracting Party applying for registration may request arbitration in accordance with the procedure in the following paragraph.
7. The request for arbitration shall not be made more than one year after the date of receipt by the Director-General of the letter of objection. Each of the two Parties to the dispute shall appoint an arbitrator. When more than one objection has been lodged against an application for registration, the High Contracting Parties which have lodged the objections shall, by common consent, appoint a single arbitrator. These two arbitrators shall select a chief arbitrator from the international list mentioned in Article I of the present Regulations. If such arbitrators cannot agree upon their choice, they shall ask the President of the International Court of Justice to appoint a chief arbitrator who need not necessarily be chosen from the international list. The arbitral tribunal thus constituted shall fix its own procedure. There shall be no appeal from its decisions.
8. Each of the High Contracting Parties may declare, whenever a dispute to which it is a Party arises, that it does not wish to apply the arbitration procedure provided for in the preceding paragraph. In such cases, the objection to an application for registration shall be submitted by the Director-General to the High Contracting Parties. The objection will be confirmed only if the High Contracting Parties so decide by a two-third majority of the High Contracting Parties voting. The vote shall be taken by correspondence, unless the Director-General of the United Nations Educational, Scientific and Cultural Organization deems it essential to convene a meeting under the powers conferred upon him by Article 27 of the Convention. If the Director-General decides to proceed with the vote by correspondence, he shall invite the High Contracting Parties to transmit their votes by sealed letter within six months from the day on which they were invited to do so.

Registration

Art. 15. 1. 1. The Director-General of the United Nations Educational, Scientific and Cultural Organization shall cause to be entered in the Register. under a serial number, each item of property for which application for registration is made, provided that he has not received an objection within the time-limit prescribed in Paragraph I of Article 14.
2. 2. If an objection has been lodged, and without prejudice to the provision of paragraph 5 of Article 14, the Director-General shall enter property in the Register only if the objection has been withdrawn or has failed to be confirmed following the procedures laid down in either paragraph 7 or paragraph 8 of Article 14.
3. 3. Whenever paragraph 3 of Article 11 applies, the Director-General shall enter property in the Register if so requested by the Commissioner-General for Cultural Property.
4. 4. The Director-General shall send without delay to the Secretary-General of the United Nations, to the High Contracting Parties, and, at the request of the Party applying for registration, to all other States referred to in Articles 30 and 32 of the Convention, a certified copy of each entry in the Register. Entries shall become effective thirty days after despatch of such copies.

Cancellation

Art. 16. 1. 1. The Director-General of the United Nations Educational, Scientific and Cultural Organization shall
cause the registration of any property to be cancelled:
(a) at the request of the High Contracting Party within whose territory the cultural property is situated;
(b) if the High Contracting Party which requested registration has denounced the Convention, and when that denunciation has taken effect;
(c) in the special case provided for in Article 14, paragraph 5, when an objection has been confirmed following the procedures mentioned either in paragraph 7 or in paragraph 8 of Article 14.
2. 2. The Director-General shall send without delay, to the Secretary-General of the United Nations and to all States which received a copy of the entry in the Register, a certified copy of its cancellation. Cancellation shall take effect thirty days after the despatch of such copies.

CHAPTER III : TRANSPORT OF CULTURAL PROPERTY

Procedure to Obtain Immunity

Art. 17. 1. 1. The request mentioned in paragraph 1 of Article 12 of the Convention shall be addressed to the Commissioner-General for Cultural Property. It shall mention the reasons on which it is based and specify the approximate number and the importance of the objects to be transferred, their present location, the location now envisaged, the means of transport to be used, the route to be followed, the date proposed for the transfer, and any other relevant information.
2. 2. If the Commissioner-General, after taking such opinions as he deems fit, considers that such transfer is justified, he shall consult those delegates of the Protecting Powers who are concerned, on the measures proposed for carrying it out. Following such consultation, he shall notify the Parties to the conflict concerned of the transfer, including in such notification all useful in formation.
3. 3. The Commissioner-General shall appoint one or more inspectors, who shall satisfy themselves that only the property stated in the request is to be transferred and that the transport is to be by the approved methods and bears the distinctive emblem. The inspector or inspectors shall accompany the property to its destination.

Transport Abroad

Art. 18. Where the transfer under special protection is to the territory of another country, it shall be governed not only by Article 12 of the Convention and by Article 17 of the present Regulations, but by the
following further provisions:
(a) while the cultural property remains on the territory of another State, that State shall be its depositary and shall extend to it as great a measure of care as that which it bestows upon its own cultural property of comparable importance;
(b) the depositary State shall return the property only on the cessation of the conflict; such return shall be effected within six months from the date on which it was requested;
(c) during the various transfer operations, and while it remains on the territory of another State, the cultural property shall be exempt from confiscation and may not be disposed of either by the depositor or by the depositary. Nevertheless, when the safety of the property requires it, the depositary may, with the assent of the depositor, have the property transported to the territory of a third country, under the conditions laid down in the present article;
(d) the request for special protection shall indicate that the State to whose territory the property is to be transferred accepts the provisions of the present Article.

Occupied Territory

Art. 19. Whenever a High Contracting Party occupying territory of another High Contracting Party transfers cultural property to a refuge situated elsewhere in that territory, without being able to follow the procedure provided for in Article 17 of the Regulations, the transfer in question shall not be regarded as misappropriation within the meaning of Article 4 of the Convention, provided that the Commissioner-General for Cultural Property certifies in writing, after having consulted the usual custodians, that such transfer was rendered necessary by circumstances.

CHAPTER IV : THE DISTINCTIVE EMBLEM

Affixing of the Emblem

Art. 20. 1. 1. The placing of the distinctive emblem and its degree of visibility shall be left to the discretion of the competent authorities of each High Contracting Party. It may be displayed on flags or armlets; it may be painted on an object or represented in any other appropriate form.
2. 2. However, without prejudice to any possible fuller markings, the emblem shall, in the event of armed conflict and in the cases mentioned in Articles 12 and 13 of the Convention, be placed on the vehicles of transport so as to be clearly visible in daylight from the air as well as from the ground.
The emblem shall be visible from the ground:
(a) at regular intervals sufficient to indicate clearly the perimeter of a centre containing monuments under special protection;
(b) at the entrance to other immovable cultural property under special protection.

Identification of Persons

Art. 21. 1. 1. The persons mentioned in Article 17, paragraph 2 (b) and (c) of the Convention may wear an armlet bearing the distinctive emblem, issued and stamped by the competent authorities.
2. 2. Such persons shall carry a special identity card bearing the distinctive emblem. This card shall mention at least the surname and first names, the date of birth, the title or rank, and the function of the holder. The card shall bear the photograph of the holder as well as his signature or his fingerprints, or both. It shall bear the embossed stamp of the competent authorities.
3. 3. Each High Contracting Party shall make out its own type of identity card, guided by the model annexed, by way of example, to the present Regulations. The High Contracting Parties shall transmit to each other a specimen of the model they are using. Identity cards shall be made out, if possible, at least in duplicate, one copy being kept by the issuing Power.
4. 4. The said persons may not, without legitimate reason, be deprived of their identity card or of the right to wear the armlet.

The Contracting Parties confirm that genocide, whether committed in time of peace or in time of war, is a crime under international law which they undertake to prevent and to punish. Article 3 Artículo 3

Persons committing genocide or any of the other acts enumerated in article III shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals. Article 5 Artículo 5

The Contracting Parties undertake to enact, in accordance with their respective Constitutions, the necessary legislation to give effect to the provisions of the present Convention, and, in particular, to provide effective penalties for persons guilty of genocide or any of the other acts enumerated in article III. Persons charged with genocide or any of the other acts enumerated in article III shall be tried by a competent tribunal of the State in the territory of which the act was committed, or by such international penal tribunal as may have jurisdiction with respect to those Contracting Parties which shall have accepted its jurisdiction. Article 7 Artículo 7

Article 8 Artículo 8

Any Contracting Party may call upon the competent organs of the United Nations to take such action under the Charter of the United Nations as they consider appropriate for the prevention and suppression of acts of genocide or any of the other acts enumerated in article III. Disputes between the Contracting Parties relating to the interpretation, application or fulfilment of the present Convention, including those relating to the responsibility of a State for genocide or for any of the other acts enumerated in article III, shall be submitted to the International Court of Justice at the request of any of the parties to the dispute. Article 10 Artículo 10

The present Convention, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall bear the date of 9 December 1948. Article 11 Artículo 11

The present Convention shall be open until 31 December 1949 for signature on behalf of any Member of the United Nations and of any nonmember State to which an invitation to sign has been addressed by the General Assembly. After 1 January 1950, the present Convention may be acceded to on behalf of any Member of the United Nations and of any non-member State which has received an invitation as aforesaid. On the day when the first twenty instruments of ratification or accession have been deposited, the Secretary-General shall draw up a proces-verbal and transmit a copy thereof to each Member of the United Nations and to each of the non-member States contemplated in article 11. The present Convention shall come into force on the ninetieth day following the date of deposit of the twentieth instrument of ratification or accession. Any ratification or accession effected, subsequent to the latter date shall become effective on the ninetieth day following the deposit of the instrument of ratification or accession. Article 14 Artículo 14

The present Convention shall remain in effect for a period of ten years as from the date of its coming into force. La presente Convención permanecerá en vigor por un período de diez años a partir de la fecha de su entrada en vigor.

It shall thereafter remain in force for successive periods of five years for such Contracting Parties as have not denounced it at least six months before the expiration of the current period. If, as a result of denunciations, the number of Parties to the present Convention should become less than sixteen, the Convention shall cease to be in force as from the date on which the last of these denunciations shall become effective. Article 16 Artículo 16

A request for the revision of the present Convention may be made at any time by any Contracting Party by means of a notification in writing addressed to the Secretary-General.
