Convención sobre la Prevención y la Sanción del Delito de Genocidio, el 9 de diciembre de 1948.

Las Partes Contratantes,

Having considered the declaration made by the General Assembly of the United Nations in its resolution 96 (I) dated 11 December 1946 that genocide is a crime under international law, contrary to the spirit and aims of the United Nations and condemned by the civilized world Habiendo examinado la declaración hecha por la Asamblea General de las Naciones Unidas en su resolución 96 (I) de fecha 11 de diciembre de 1946 que el genocidio es un delito en virtud del derecho internacional, contrario al espíritu ya los objetivos de las Naciones Unidas y condenado por el mundo civilizado


Recognizing that at all periods of history genocide has inflicted great losses on humanity, and Reconociendo que en todos los períodos de la historia el genocidio ha infligido grandes pérdidas a la humanidad, y


Being convinced that, in order to liberate mankind from such an odious scourge, international co-operation is required, Estar convencidos de que, con el fin de liberar a la humanidad de ese flagelo odioso, la cooperación internacional es necesaria,


Hereby agree as hereinafter provided: Convienen en lo adelante siempre que:


Article 1 Artículo 1


The Contracting Parties confirm that genocide, whether committed in time of peace or in time of war, is a crime under international law which they undertake to prevent and to punish. Las Partes contratantes confirman que el genocidio, ya sea cometido en tiempo de paz o en tiempo de guerra, es un delito en virtud del derecho internacional que se comprometen a prevenir ya sancionar.


Article 2 Artículo 2


In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such: En la presente Convención, se entiende por genocidio cualquiera de los siguientes actos cometidos con la intención de destruir, en todo o en parte, un grupo nacional, étnico, racial o religioso, como tal:


(a) Killing members of the group; (a) Matanza de miembros del grupo;


(b) Causing serious bodily or mental harm to members of the group; (b) Lesión grave a la integridad física o mental de los miembros del grupo;


(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; (c) Sometimiento intencional del grupo a condiciones de existencia que hayan de acarrear su destrucción física, total o parcial;


(d) Imposing measures intended to prevent births within the group; (d) Medidas destinadas a impedir los nacimientos en el seno del grupo;


(e) Forcibly transferring children of the group to another group. (e) Traslado por fuerza de niños del grupo a otro grupo.


Article 3 Artículo 3


The following acts shall be punishable: Los siguientes actos serán castigados:


(a) Genocide; (a) Genocidio;


(b) Conspiracy to commit genocide; (b) La conspiración para cometer genocidio;


(c) Direct and public incitement to commit genocide; (c) La instigación directa y pública a cometer genocidio;


(d ) Attempt to commit genocide; (d) La tentativa de genocidio;


(e) Complicity in genocide. (e) La complicidad en el genocidio.


Article 4 Artículo 4


Persons committing genocide or any of the other acts enumerated in article III shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals. Las personas que hayan cometido genocidio o cualquiera de los otros actos enumerados en el artículo III serán castigadas, ya se trate de gobernantes, funcionarios públicos o particulares.


Article 5 Artículo 5


The Contracting Parties undertake to enact, in accordance with their respective Constitutions, the necessary legislation to give effect to the provisions of the present Convention, and, in particular, to provide effective penalties for persons guilty of genocide or any of the other acts enumerated in article III. Las Partes Contratantes se comprometen a adoptar, de conformidad con sus respectivas Constituciones, la legislación necesaria para dar efecto a las disposiciones de la presente Convención, y, en particular, para proporcionar una penalización efectiva de las personas culpables de genocidio o de cualquiera de los otros actos enumerados en el el artículo III.


Article 6 Artículo 6


Persons charged with genocide or any of the other acts enumerated in article III shall be tried by a competent tribunal of the State in the territory of which the act was committed, or by such international penal tribunal as may have jurisdiction with respect to those Contracting Parties which shall have accepted its jurisdiction. Las personas acusadas de genocidio o de cualquiera de los otros actos enumerados en el artículo III serán juzgadas por un tribunal competente del Estado en cuyo territorio el acto fue cometido, o ante la corte penal internacional que sea competente en lo que respecta a las Partes Contratantes que han aceptado su jurisdicción.


Article 7 Artículo 7


Genocide and the other acts enumerated in article III shall not be considered as political crimes for the purpose of extradition. El genocidio y los otros actos enumerados en el artículo III no serán considerados como delitos políticos a efectos de extradición.

The Contracting Parties pledge themselves in such cases to grant extradition in accordance with their laws and treaties in force. Las Partes Contratantes se comprometen en esos casos a conceder la extradición de conformidad con sus leyes y los tratados en vigor.


Article 8 Artículo 8


Any Contracting Party may call upon the competent organs of the United Nations to take such action under the Charter of the United Nations as they consider appropriate for the prevention and suppression of acts of genocide or any of the other acts enumerated in article III. Cualquier Parte Contratante podrá recurrir a los órganos competentes de las Naciones Unidas a tomar las medidas en virtud de la Carta de las Naciones Unidas que consideren adecuadas para la prevención y represión de los actos de genocidio o de cualquiera de los otros actos enumerados en el artículo III.


Article 9 Artículo 9


Disputes between the Contracting Parties relating to the interpretation, application or fulfilment of the present Convention, including those relating to the responsibility of a State for genocide or for any of the other acts enumerated in article III, shall be submitted to the International Court of Justice at the request of any of the parties to the dispute. Las controversias entre las Partes Contratantes relativas a la interpretación, aplicación o cumplimiento de la presente Convención, incluidas las relativas a la responsabilidad de un Estado por genocidio o de cualquiera de los otros actos enumerados en el artículo III, serán presentadas a la Corte Internacional de Justicia a petición de cualquiera de las partes en la controversia.


Article 10 Artículo 10


The present Convention, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall bear the date of 9 December 1948. La presente Convención, de los cuales el chino, Inglés, francés, ruso y español son igualmente auténticos, llevará la fecha de 9 de diciembre de 1948.


Article 11 Artículo 11


The present Convention shall be open until 31 December 1949 for signature on behalf of any Member of the United Nations and of any nonmember State to which an invitation to sign has been addressed by the General Assembly. La presente Convención estará abierta hasta el 31 de diciembre 1949 a la firma en nombre de cualquier Miembro de las Naciones Unidas y terceros de cualquier Estado al que una invitación a firmar se ha abordado por la Asamblea General.


The present Convention shall be ratified, and the instruments of ratification shall be deposited with the Secretary-General of the United Nations. El presente Convenio será ratificado, y los instrumentos de ratificación serán depositados ante el Secretario General de las Naciones Unidas.


After 1 January 1950, the present Convention may be acceded to on behalf of any Member of the United Nations and of any non-member State which has received an invitation as aforesaid. Después del 1 de enero de 1950, la presente Convención puede ser adherido a ella en nombre de cualquier Miembro de las Naciones Unidas y de cualquier Estado no miembro que ha recibido una invitación citadas. Instruments of accession shall be deposited with the Secretary-General of the United Nations. Los instrumentos de adhesión se depositarán en poder del Secretario General de las Naciones Unidas.


Article 12 Artículo 12


Any Contracting Party may at any time, by notification addressed to the Secretary-General of the United Nations, extend the application of the present Convention to all or any of the territories for the conduct of whose foreign relations that Contracting Party is responsible. Cualquier Parte Contratante podrá en cualquier momento, mediante notificación dirigida al Secretario General de las Naciones Unidas, extender la aplicación de la presente Convención a todos o cualquiera de los territorios de la conducta de sus relaciones exteriores esa Parte Contratante es el responsable.


Article 13 Artículo 13


On the day when the first twenty instruments of ratification or accession have been deposited, the Secretary-General shall draw up a proces-verbal and transmit a copy thereof to each Member of the United Nations and to each of the non-member States contemplated in article 11. En el día en que los primeros veinte instrumentos de ratificación o de adhesión se hayan depositado, el Secretario General elaborará un acta y transmitirá una copia de la misma a cada uno de los Miembros de las Naciones Unidas ya cada uno de los Estados no miembros que se contempla en artículo 11.


The present Convention shall come into force on the ninetieth day following the date of deposit of the twentieth instrument of ratification or accession. El presente Convenio entrará en vigor al nonagésimo día contado desde la fecha de depósito del vigésimo instrumento de ratificación o de adhesión.


Any ratification or accession effected, subsequent to the latter date shall become effective on the ninetieth day following the deposit of the instrument of ratification or accession. Toda ratificación o de adhesión a cabo, con posterioridad a la última fecha entrará en vigor el nonagésimo día siguiente al del depósito del instrumento de ratificación o de adhesión.

Article 14 Artículo 14


The present Convention shall remain in effect for a period of ten years as from the date of its coming into force. La presente Convención permanecerá en vigor por un período de diez años a partir de la fecha de su entrada en vigor.

It shall thereafter remain in force for successive periods of five years for such Contracting Parties as have not denounced it at least six months before the expiration of the current period. Será entonces permanecerá en vigor por períodos sucesivos de cinco años para las Partes Contratantes, tales como no han denunciado al menos seis meses antes de la expiración del período actual.


Denunciation shall be effected by a written notification addressed to the Secretary-General of the United Nations. La denuncia se efectuará mediante notificación escrita dirigida al Secretario General de las Naciones Unidas.

Article 15 Artículo 15


If, as a result of denunciations, the number of Parties to the present Convention should become less than sixteen, the Convention shall cease to be in force as from the date on which the last of these denunciations shall become effective. Si, como consecuencia de las denuncias, el número de Partes en la presente Convención debería ser inferior a dieciséis, la Convención dejará de estar en vigor a partir de la fecha en que la última de estas denuncias se hará efectivo.

Article 16 Artículo 16


A request for the revision of the present Convention may be made at any time by any Contracting Party by means of a notification in writing addressed to the Secretary-General. La solicitud para la revisión de la presente Convención podrá hacerse en cualquier momento por cualquiera de las Partes Contratantes mediante notificación escrita dirigida al Secretario General.


The General Assembly shall decide upon the steps, if any, to be taken in respect of such request. La Asamblea General decidirá las medidas que, en su caso, que se adopten respecto de dicha solicitud.


Article 17 Artículo 17


The Secretary-General of the United Nations shall notify all Members of the United Nations and the non-member States contemplated in article XI of the following: El Secretario General de las Naciones Unidas notificará a todos los Miembros de las Naciones Unidas y los Estados no miembros que se contempla en el artículo XI de los siguientes:


(a) Signatures, ratifications and accessions received in accordance with article 11; (a) Las firmas, ratificaciones y adhesiones recibidas de conformidad con el artículo 11;


(b) Notifications received in accordance with article 12; (b) Las notificaciones recibidas de conformidad con el artículo 12;


(c) The date upon which the present Convention comes into force in accordance with article 13; (c) La fecha en que el presente Convenio entre en vigor, de conformidad con el artículo 13;


(d) Denunciations received in accordance with article 14; (d) las denuncias recibidas de conformidad con el artículo 14;


(e) The abrogation of the Convention in accordance with article 15; (e) La abrogación de la Convención, de conformidad con el artículo 15;


(f) Notifications received in accordance with article 16. (f) Las notificaciones recibidas de conformidad con el artículo 16.


Article 18 Artículo 18


The original of the present Convention shall be deposited in the archives of the United Nations. El original del presente Convenio se depositará en los archivos de las Naciones Unidas.


A certified copy of the Convention shall be transmitted to each Member of the United Nations and to each of the non-member States contemplated in article XI. Una copia certificada de la Convención se remitirá a cada uno de los Miembros de las Naciones Unidas ya cada uno de los Estados no miembros contemplados en el artículo XI.


Article 19 Artículo 19


The present Convention shall be registered by the Secretary-General of the United Nations on the date of its coming into force. La presente Convención será registrada por el Secretario General de las Naciones Unidas en la fecha de su entrada en vigor.
